Terms of Service
1. Scope
These terms govern your use of Seeker Burn Club, including the website (seekerburnclub.xyz), Android app, and API. By using the platform, you accept these terms. If you do not agree, stop using the service.
2. Eligibility
You must be at least 18 years old to use this platform. By using the service, you confirm that you meet this age requirement and are legally capable of entering into a binding agreement.
3. Service Description
Seeker Burn Club is a gamified Solana DApp. It lets you record token burn and deposit activity, build streaks, earn badges, mint badge NFTs, spawn procedural creature spirits, track leaderboard rankings, and participate in a referral system. The platform verifies on-chain transactions and maintains off-chain records of your activity.
Additional features include:
- XP & Leveling: Burns, badges, and challenges award experience points (XP). XP determines your level and title — purely cosmetic, with no monetary value.
- Lucky Burns: Burns of 3 SKR or more trigger a randomized reward wheel. All rewards are virtual in-game items (XP boosts, streak shields, buffs) with no monetary or redeemable value.
- Shield Shop: You may purchase streak shields using SKR tokens. Shields protect your burn streak and are consumed on use. Purchases are non-refundable.
- Daily & Weekly Challenges: Time-limited tasks that award XP and streak shields upon completion.
- Inventory & Buffs: Items collected from Lucky Burns are stored in your inventory and can be activated as temporary buffs (e.g., XP multipliers, luck boosts).
4. Wallet and Key Responsibility
- You need a compatible Solana wallet to use the platform.
- You are solely responsible for your private keys, seed phrases, and wallet security.
- We never ask for or store your private keys or seed phrases.
- Authentication happens via SIWS (Sign In With Solana) — you sign a challenge message to prove wallet ownership.
- If you lose access to your wallet, we cannot recover it or transfer your account.
5. Token Burns Are Irreversible
When you burn SKR tokens through the platform, those tokens are permanently and irreversibly destroyed on the Solana blockchain. There is no undo, no refund, and no recovery possible. By submitting a burn transaction, you explicitly acknowledge and accept this irreversibility. The platform does not control or reverse blockchain transactions.
6. Virtual Items and In-Game Economy
- Streak shields, XP boosts, buffs, lucky drop items, and all other in-game items are virtual utility items with no monetary value.
- Virtual items are non-transferable, non-tradable, and non-redeemable for tokens, currency, or any other consideration.
- There is no secondary market, cash-out mechanism, or conversion of in-game items to real-world value.
- SKR spent in the Shield Shop is consumed as a platform transaction and is non-refundable.
- Lucky Burns rewards are determined by a randomized algorithm. You have no claim to any specific outcome.
- We reserve the right to modify, rebalance, or remove virtual items, rewards, or features at any time without prior notice.
7. Platform Fee
A small percentage (currently 1%) of each burn transaction is sent to the Community Treasury as a platform fee. This fee is disclosed before every transaction and is non-refundable.
8. No Financial, Tax, or Legal Advice
Nothing on this platform constitutes financial, investment, tax, or legal advice. Seeker Burn Club is not a financial intermediary and does not provide investment recommendations. Token burns, deposits, and NFT minting are gamification features — not financial instruments. You act entirely at your own risk and discretion.
This platform is not licensed or supervised by FINMA (Swiss Financial Market Supervisory Authority) and does not offer regulated financial services.
9. Risk Acknowledgment
By using this platform, you acknowledge and accept:
- Blockchain risks: Network congestion, failed transactions, validator downtime, protocol changes, or forks on Solana may affect your experience.
- Token value: SKR tokens and NFTs may have no monetary value. Their value can fluctuate unpredictably or drop to zero.
- Smart contract risk: On-chain programs may contain bugs or behave unexpectedly despite testing.
- Wallet risk: Loss or compromise of your wallet is your responsibility alone.
- Third-party dependencies: The platform relies on Solana, RPC providers, and hosting infrastructure. Outages or changes to these services are outside our control.
10. Acceptable Use
- No attacks against the API, infrastructure, smart contracts, or other users.
- No manipulation or abuse of the referral system, leaderboards, badges, or reward mechanisms.
- No multi-account schemes to gain unfair advantage.
- No automated access (bots, scrapers) without written permission.
- No use that violates applicable law.
11. Termination and Suspension
We may restrict, suspend, or terminate your access at any time if we reasonably believe you have violated these terms, engaged in abuse, or pose a security risk. Where practical, we will provide notice and an explanation. On-chain assets (NFTs, transaction history) remain on the blockchain regardless of your platform access status.
12. Intellectual Property
The Seeker Burn Club name, visual design, creature generation system, badge artwork, and website content are the property of the operator. You may not copy, reproduce, or redistribute them without permission. Open-source components remain under their respective licenses. NFTs you have minted belong to your wallet.
13. Warranty Disclaimer
The platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee uptime, accuracy, completeness, or fitness for any particular purpose. We do not guarantee that the platform will be error-free, uninterrupted, or secure at all times.
14. Liability
To the extent permitted under Swiss law:
- Liability for slight negligence is excluded, except where mandatory law provides otherwise.
- Liability for intent and gross negligence cannot and is not excluded (Art. 100 OR).
- We are not liable for damages arising from blockchain transactions, token value changes, wallet loss, third-party service failures, or force majeure events.
- Where liability applies, it is limited to direct, foreseeable damages. Indirect, incidental, or consequential damages are excluded to the extent permitted by law.
15. Force Majeure
We are not liable for failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to: natural disasters, power outages, internet failures, blockchain network outages, regulatory actions, cyberattacks, pandemics, or government orders.
16. Changes to These Terms
We may update these terms. The current version is always available at /terms. Continued use after changes constitutes acceptance. Material changes are reflected in the "Last updated" date above.
17. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions stay in full force. The invalid provision will be replaced with a valid one that most closely achieves the original intent.
18. Governing Law and Jurisdiction
These terms are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law provisions.
The exclusive place of jurisdiction is Urdorf, Zurich, Switzerland. Mandatory statutory jurisdiction rules remain reserved.
